Contracts are important documents that bind the parties into an agreement. People and businesses enter contracts every day. At the PD Law Firm, P.A. we understand that people and businesses are not all the same and “one size fits all” contracts do not always work. The PD Law Firm, P.A. can help you or your business draft contracts for any transaction or review contracts already in place.
In the event contract disputes arise, the PD Law Firm, P.A. has the expertise and experience to help you obtain the best results. We can explore that possible solutions in cases of breach of contract:
- Monetary Damages: the injured party may seek money damages in the event of a breach of contract. Monetary damages seek to place the injured party in the position they would have been had the contract been fulfilled. Monetary damages include damages incurred due to failure to perform the contract.
- Liquidated Damages: Liquidated damages are those agreed upon in the contract in the event of a breach. Often, contracts include a provision specifying an amount in damages to be paid to the injured party in the event of a breach.
- Specific Performance: In certain situations, monetary or liquidated damages would not remedy the breach. Specific performance will enforce the performance of the contract and seek to place the injured party in the position they would have been had the contract been fulfilled. Specific performance is often the remedy in contracts involving the sale of unique items that cannot be replaced, such as artworks and real estate but not in a contract for services.
