Unlawful Presence Waiver

Certain applicants may qualify for a waiver in order prevent separation and hardship to their U.S. citizen or resident relatives. Unlawful presence waivers allow the applicants to obtain provisional “pardon” before attending an interview at a consulate abroad and be able to return to the U.S. This waiver process allows those who may have overstayed their visas or entered without a visa to regularize their immigration status.

In order to obtain an unlawful presence waiver one must:

  • Be physically present in the U.S. at the time of filling waiver.
  • Have an approved petition by a U.S. citizen or permanent resident immediate relative.
  • Show extreme hardship to the U.S. citizen or permanent resident immediate relative.
